Terms and Conditions
3D Health Group Pty Ltd is a registered business ABN 94 624 709 011. We are an Australian owned wellness studio based in Bendigo, Victoria. We offer an holistic approach to optimal health and wellbeing through our range of products and services.
We engage a number of allied health practitioners under our brand or who operate from our premises, who may hold their own individual registrations, ABN and insurance policies which are separate to ours. Their further terms and conditions will also apply to your relationship with them. We are not a party to those relationships.
Tailoring Our Services
When you engage us to provide you with services such as physio consults, other allied health services, supervised and unsupervised classes and gym sessions, we ask you to give us details about your medical history, medical conditions, physical limitations and anything else we should be aware of that could impact your treatment plan. The information you provide is used to tailor our support to you. We may refer you to other medical or allied health professionals to support you where other specialities are required or recommended to interact with our advice.
Our Fees
Our rates are subject to change at any time. Unless otherwise specified, payment is required on the day of your appointment. For some services you may be required to pay a 50% deposit. This deposit is used for part payment of your appointment. Your deposit will be non-refundable if you fail to attend the appointment without notifying us at least 2 hours prior to the time of the appointment. Your booking will not be confirmed until payment is received.
If for any reason we provide a service to you and you do not pay your invoice on time, unfortunately we will be required to pass on interest at 10% annually, calculated monthly plus associated legal fees and/or debt collector fees.
Different payment methods may be offered via third party providers. All payment providers have their own terms and conditions which apply in addition to ours. It is your responsibility to read and accept them.
You are Responsible for your Safety
Many of the services that we offer come with inherent risks to your health and safety. This means it is vital that we have an accurate and up to date understanding of your health and fitness and you tell us of all relevant conditions and limitations - before we start providing services, when anything changes and regularly if we are providing services on an ongoing basis so that we can keep you as safe as possible.
We will provide you with instructions on proper use of facilities and equipment before we provide you with those services. If you are not confident, do not understand those instructions, forget the instructions, or your physical condition has changed since your last assessment with us, it is your responsibility to seek clarification. You should not use any facilities or equipment until you have received and understood our instructions on how to use them safely.
All activities involving physical fitness and activity carry inherent risk of injury even if you do follow instructions. If you are pregnant or have any physical or mental restriction, disability, vulnerability, or condition which makes you susceptible to injury, you should consult your chosen medical professionals to make an individual plan that suits you.
You agree that all services are obtained at your sole risk subject only to our professional obligations which cannot be excluded by law.
You are Responsible for Other’s Safety
Where you are in a class or gym setting, your actions or inactions can cause risk of injury to those around you. Please ensure to keep all equipment and personal items out of the way of walkways and where they may cause a hazard to any other person.
Concerns or Complaints
If you have any concerns or complaints at any time regarding our services or facilities, please raise it immediately with us to allow us the opportunity to correct it.
Limitation of Liability
We are not general medical professionals and any information we offer is given on a limited liability basis according to the limitations of our professional qualifications and registrations. We may require you to check with your GP where there are any medical conditions or limitations impacting you. The advice we offer relates to musculoskeletal and movement related conditions. We do not claim to diagnose, prevent or treat any other illness, disease or condition.
You acknowledge and agree that injury is a real possibility when participating in health and wellbeing programs including exercise and agree to assume that risk voluntarily. To the extent permitted by law, you agree to release 3D Health Group from any claim for injury, death, loss, costs, claims or damages occurring at, or arising from, your use of our services and will not claim compensation from 3D Health Group including (without limitation) where such matters arise due to:
i.the materialisation of an inherent risk;
ii. any circumstances we have lawfully excluded in these T&Cs;
iii. your breach of these T&Cs, your reckless or negligent conduct, or your unlawful act or omission;
iv.any other claim related in any way to your use of the services,
except to the extent that these matters arise due to our professional misconduct or negligence.
To the maximum extent permitted by law, our liability to you is limited to the fees you have paid us for the affected service or the cost of having the service provided again, whichever is higher. If you have not paid us any amounts, our liability is limited to $100. 3D Health Group are not liable for any indirect, incidental, punitive, special, or consequential damages of any kind. In this section, 3D Health Group includes our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers and licensors and we hold the benefit of this agreement on trust for them.
In these T&Cs, the term injury includes an aggravation, acceleration or recurrence of a pre-existing injury, disease or condition.
Variation: We may vary these T&Cs and they will apply immediately upon posting the varied T&Cs on our website.
Assignment: We may assign these T&Cs to any other person at any time. If we do so, we will post notice on our website and if applicable, place a sign in our premises.
Whole Agreement: These T&Cs form the whole agreement between us and may not be varied orally. Our Privacy Policy also applies to our relationship.
Applicable Law: The laws of Victoria, Australia govern these T&Cs. Where the Australian Consumer Law is applicable to your use of the services, our policies, terms and conditions are to be read subject to that law, with any modifications we have made which are not made contrary to that law.

You have the right to access and correct your personal information by contacting the business.
Complaints about privacy breaches can be made to the business, and if unresolved, can be escalated to the Office of the Australian Information Commissioner (OAIC).
